“The People’s Friend” Photoshoot Competition Terms & Conditions


TERMS AND CONDITIONS FOR COMPETITIONS 

These are our competition terms and conditions for the People’s Friend Marketing Photoshoot Competition featured in our email of Tuesday 18th October 

  1. The promoter 

The promoter is D.C. Thomson & Company Limited (a company registered in Scotland with company no. 005830) whose registered address is at Courier Buildings, 2 Albert Square, Dundee, Scotland, DD1 9QJ (“DCT”).  

2. The competition 

2.1 Entrants to the People’s Friend Marketing Photoshoot Competition are asked to share a photograph of themselves reading the People’s Friend magazine in a friendly way that embodies the readership.

3. How to enter 

3.1 The competition will run from 9.30am on Tuesday 18th October (the “Opening Date“) to 6pm on Monday 24th October (the “Closing Date“) inclusive.

3.2 All competition entries must be received by DCT by no later than 6pm on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.  

3.3 To enter the competition entrants should send their photograph along with their full name, date of birth, contact email and phone number to shoot@thepeoplesfriend.co.uk by the Closing Date. 

3.4 No purchase necessary. 

3.5 DCT will not accept: 

(a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or  

(b) proof of transmission as proof of receipt of entry to the competition. 

3.6 DCT reserves the right to void any entry which, in DCT’s opinion, contains material which is obscene, defamatory, offensive or goes against the spirit of the competition.  

3.7 By submitting a competition entry, you are agreeing to be bound by these terms and conditions. DCT reserves the right to void any entry which it deems to be in breach of these terms and conditions.  

3.8 By submitting a competition entry, you confirm that your entry is an original work and does not infringe the rights of a third party.  

3.9 A winner will be chosen by a judging panel of four judges based on the photographs which they determine show the friendliest People’s Friend readers. The decision of the panel of judges (acting reasonably) will be final.  

4. Eligibility 

4.1 The competition is open to all residents in the UK aged 18 years or over, except: 

(a) employees of DCT or its holding or subsidiary companies; or 

(b) members of the immediate families or households of (a) above. 

4.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. DCT may require you to provide proof that you are eligible to enter the competition. 

5. The prize 

5.1 The prize is a day trip to Taypark House Hotel which includes return transportation, a makeover (hair and makeup included), photoshoot, refreshments plus a £50 M&S Voucher. There is a maximum of five prizes available.  

5.2 The prize does not include overnight accommodation. 

5.3 The prize is not negotiable or transferable. There is no cash alternative for the prize. 

6. Winners 

6.1 The decision of DCT regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it. 

6.2 DCT will contact the winner using the telephone number or email address provided with the competition entry within two days of the Closing Date.  

6.3 DCT must either publish or make available information that indicates that a valid award took place. To comply with this obligation DCT will send the surname and county of major prize winners and, if applicable copies of their winning entries, to anyone who emails shoot@thepeoplesfriend.co.uk or writes to the address set out in Clause 1 (enclosing a self-addressed envelope) within one month after the Closing Date of the competition.  

6.4 If you object to any or all of your surname, county and winning entry being published or made available, please contact DCT at shoot@thepeoplesfriend.co.uk. In such circumstances, DCT must still provide the information and winning entry to the Advertising Standards Authority on request.  

7. Claiming the prize 

7.1 If you are the winner of the Prize, you will have 1 day from the date that you are first notified of your winning entry. To claim the prize, you should reply to the winning notification email sent from shoot@thepeoplesfriend.co.uk  

7.2 DCT will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 1 day of notification, DCT reserves the right to offer the prize to the next eligible entrant selected by the judging panel.  

7.3 DCT does not accept any responsibility if you are not able to take up the prize. 

8. Limitation of liability 

Insofar as is permitted by law, DCT, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of DCT, its agents or distributors or that of their employees. Your statutory rights are not affected. 

9. Ownership of competition entries and intellectual property rights 

9.1 All competition entries and any accompanying material submitted to DCT will become the property of DCT on receipt and will not be returned. 

9.2 By submitting your competition entry and any accompanying material, you agree to: 

(a) assign to DCT all your intellectual property rights with full title guarantee; and 

(b) waive all moral rights, in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world. 

10. Data protection and publicity 

10.1 DCT will only process your personal information as set out in the privacy policy. See also condition 6.3 and condition 6.4, with regard to the announcement of winners.

11. General 

11.1 If there is any reason to believe that there has been a breach of these terms and conditions, DCT may, at its sole discretion, reserve the right to exclude you from participating in the competition. 

11.2 DCT reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so. 

11.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
